Why we ask what you sell
A trademark is not a claim on a word. It is a claim on a word for particular goods or services, and that changes the answer.
- The same name can belong to two owners. DELTA is an airline and a tap manufacturer, because nobody buying a tap wonders about the airline.
- So the field decides which registrations matter. An identical mark in an unrelated field may not stand in your way, and a merely similar one in yours may.
- It is also what an examiner compares. They weigh how alike the marks are against how related the goods are, which is why a checker that only takes the word cannot answer this.
