A lot of founders pick a name, buy the domain and print labels before anyone checks the trademark register. Sometimes the name turns out to be taken. That information was public the whole time, but it sits in a government database built for examiners, and most people don't know to look there.
LaunchTime IP runs that check first. You enter the name and what you sell, and the report lists what's already registered, what's close enough to cause trouble, and how strong the name is likely to be if you file.
Every search queries the USPTO's live trademark register, including pending applications.
Two marks can conflict without being spelled the same. The search also looks for names that sound alike (KWIK and QUICK) or mean the same thing.
The name is checked against the legal grounds the USPTO uses to refuse applications, such as descriptiveness, surnames and place names.
Each report gives a registrability score from 1 to 10 and a short explanation of the risk for the goods you sell.
Expert also looks outside the federal register: businesses already using the name without registering it, state business records that can be searched online, and domain availability.
